29 CFR 1910.147(f)(2)(ii):The on-site employer shall ensure that his/her employees understand and comply with the restrictions and prohibitions of the outside employer's energy control program. On or about October 7, 2020, the employer did not ensure employees understood the restrictions of the contracted employer's lock out, tag out program in that Rumpke employees approached a methane well that had not been locked out by contractors brought on by Motauk Energy to perform service on methane wells cutting HDPE pipe, exposing them to burn hazards.
