29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushing hazards from the potential roll over of a tractor while operating it on a sloped and uneven area. (a) Reclaim Site, Falling Waters: On October 5, 2020, an employee was spreading lime, using a New Holland T3.80F Tractor on an area with soggy conditions and a slope ranging from 13.3 to 22.6 degrees. The roll over protective structure (ROPS) were not used to protect against crushing injuries in the event the tractor overturned.
