29 CFR 1910.269(r)(8): Fall protection. Each employee was not tied in with a climbing rope and safety saddle when the employee is working above the ground in a tree, unless he or she is ascending into the tree. a) Location - 93 line, within span 74 near 881 Jay Street, Lebanon, PA: An employee was repositioning in a tulip poplar approximately 32 feet above the ground. The employer did not ensure that the employee was using one hundred percent tie off when changing positions resulting in a fall of 32 feet, on or about September 30, 2020. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
