Text For Citation: 01 Item/Group: 001 Hazard:
29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) On or about April 30, 2020, and at times prior, the employer did not ensure that employees conducting work in a trench were fully protected from cave-in and struck-by hazards, in that work performed to install a new sewer line was done adjacent to an unprotected vertical wall. The vertical wall collapsed dislodging large soil clods into the east end of the box where an employee was struck, suffering extensive ligament injuries to his right leg.
