29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) On July 20, 2017, employees working in the water treatment building were observed wearing 3M N95 Dust Masks while dumping lime (respiratory irritation) into a slurry tank and had not been medically evaluated before being required to use the respirator in the workplace.
