Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee in that the employee was exposed to a crushing hazard caused by a powered industrial truck tip over. Jobsite: On or about July, 23, 1996 an employee drove a clark powered industrial truck on to a wet grassy area and got stuck in the mud, while attempting to free the truck with a retrieval line attached, the truck tipped over pinning the driver underneath. One means of abatement is to adequately train the operators in the operations and limitations specified in manufacturers safety manuals for powered industrial trucks.ial
