Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to serious burns while having most of their body above and in close proximity to an open topped tank which contained a Citric Acid and hot water solution at approximately 160 degrees F: Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide a cover over the tank to protect employees from falling into the tank. USS Kauffman Bath Iron Works Shipyard, Portland, Maine On or about 08/12/92, an employee of Atlantic Coast Environmental Inc., received first and second degree burns when he fell into a tank of hot Citric Acid and water solution while attempting to add a 50# bag of Citric Acid to the solution. There was no cover over the tank to prevent the employee from falling into the tank.
