Abstract: At 9:30 p.m. on December 30, 2014, two patrol boats were assigned to rescue the unmanned 63 foot commercial diving boat, the Neptune King, which had come off its moorings during a storm and was drifting towards private boats anchored in the harbor. As one of the two patrol boats came upon the Neptune King, Employee #1, jumped onto the Neptune King in an attempt to start the boats engine and to tie the thrown tow lines onto the Neptune King's cleaves. During the course of the incident, Employee #1 and the crew of the patrol boats made three attempts to pull the Neptune King out of harm's way. On the first two attempts the tow line broke, on the third attempt, one of the cleaves pulled off of the Neptune King. After each attempt the ship drifted closer to shore. After the third attempt the patrol boats found themselves inside of the wave breakers and feared the patrol boats would be swamped, therefore they abandoned the rescue mission and moved out to sea, leaving Employee #1 on the Neptune King. As the Neptune King drifted closer to shore, Employee #1 decided to jump off of the Neptune King and attempt to swim to a stone stairwell located on the beachhead of the cove. As Employee #1 made his way to the stone stairwell, the Neptune King washed up against him and drove him into the stairwell, knocking him unconscious. As police attempted to reach him, the Neptune King washed up against the stone stairwell a second time and settled on top of Employee #1, crushing and killing him.
