Abstract: In late 2020, an employee was working for a municipal police department. He was one of the lieutenants who sat behind a desk in the watch command office, monitoring patrol staff. He shared the office with two other two lieutenants on the command watch staff. Only one person was required to be in the office during each shift, but there was a one-to-two-hour overlap in the schedules with the two other lieutenants who were assigned to work in the office. The office had four desks, one in each corner. The last day that the employee worked at the office was November 19, 2020. On November 29, 2020, he tested positive for COVID-19. On December 2, 2020, he was admitted to a hospital. At 5:53 a.m. on January 17, 2021, he died, due to COVID-19. At 8:21 a.m. on January 19, 2021, the employer reported the incident to the Division. The employer did not comply with the reporting requirements. The human resources benefits supervisor interviewed the employee before his death. The employee indicated that he had not been wearing any face coverings. The Division found no accident-related violations.
